⚖️ Arbitration and Dispute Resolution Mechanism

This clause establishes that any user who utilizes the PayGlobalCoin platform, website, or any related services, whether directly or indirectly entering into a legal relationship with PayGlobalCoin, acknowledges and agrees that any dispute, claim, or legal proceeding arising from such relationship shall be resolved through arbitration, in accordance with the terms set forth below.

1. Jurisdiction and Legal Framework

All disputes related to:

  • The purchase, storage, or use of PayGlobalCoin tokens (PGC);
  • Access to the platform or website;
  • Interpretation, breach, or execution of contractual terms,
shall be governed by internationally recognized arbitration rules, as determined at PayGlobalCoin's discretion.

The geographic venue for arbitration shall be a neutral location that ensures impartiality, professionalism, and transparency of the legal process.

Disputes will be adjudicated under general principles of civil law and international arbitration standards. The official language of the proceedings shall be English.

2. Composition and Procedure

Arbitration shall be conducted by one (1) or three (3) independent, neutral arbitrators, selected in accordance with the established procedure and by mutual agreement.

Arbitrators must be professionally qualified and act in compliance with applicable standards of impartiality and law.

The arbitration procedure shall ensure confidentiality, equality, and prompt resolution. Each party shall have equal opportunity to present evidence and exercise the right to defense.

3. Effect of Arbitration Consent

By using any PayGlobalCoin service, the user confirms and agrees that:

  • They waive the right to submit a legal dispute to public court, except as defined in the exceptions clause below;
  • The final decision by the arbitration tribunal shall be binding and enforceable;
  • The user assumes responsibility to comply with the arbitration outcome to the extent permitted by applicable law.

4. Exceptions

PayGlobalCoin reserves the right to seek public legal mechanisms under circumstances including, but not limited to:

  • When required by applicable legal frameworks or upon initiation of a legal process by a competent regulatory authority, including investigations under anti-money laundering (AML) laws.
  • Notably, the PayGlobalCoin platform enforces internal limitations under which each user may purchase PGC tokens with a minimum equivalent of $1 and a maximum of $10,000. This serves as an internal control mechanism aimed at reducing AML risks and standardizing user behavior on the platform. However, this mechanism does not replace or override regulatory obligations and shall not be construed as a guarantee against potential violations.
  • When urgent interim relief is necessary, which can only be granted through court intervention;
  • When the nature of the dispute, under applicable law, is not subject to arbitration and must be exclusively resolved in court.

PayGlobalCoin cooperates with trusted international arbitration bodies. Users may refer disputes to one of the following institutions:
